Clear terms for one-off work.
These terms apply when you order a ready-made collectible or commission work from Burnt Toast. Please read them before placing an order.
Burnt Toast is a trading name of FMC NE LTD, company number 14433237, registered at 5 Dundas Street, Redcar, England, TS10 3AD. Contact: hello@burnttoast.uk.
1. About our pieces
Burnt Toast creates hand-finished adult display collectibles and custom commissions. Many pieces are one-offs. Small variations, surface texture and evidence of hand finishing are part of their individual character and are not faults.
Product photographs and descriptions are prepared carefully. Screen settings, lighting and photography can affect colour appearance. Measurements are approximate unless stated otherwise.
2. Adult collectibles
Our pieces are intended for adult collectors and display. They are not toys and may include delicate parts, sharp points or small components. They must be kept away from children and handled, displayed and stored responsibly.
3. Orders and the contract
Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. A contract is formed when we send an acceptance or dispatch confirmation, or otherwise expressly confirm the order.
Because ready-made pieces are one-offs, availability can change. If the same piece is ordered twice because of a technical or timing issue, we will accept only the first valid order and refund any later payment promptly.
We may decline or cancel an order before acceptance where a product is unavailable, information or pricing is clearly incorrect, payment cannot be authorised, delivery is impractical, or we reasonably suspect fraud or misuse.
4. Prices and payment
Prices are displayed in pounds sterling unless stated otherwise. Delivery charges are added before payment. International customers may also be charged import VAT, customs duties, brokerage fees or local charges by their destination country.
Payment is processed securely by PayPal and any other payment provider shown at checkout. We do not receive your full card details. Payment must clear before a ready-made piece is dispatched or commission work begins, unless we agree staged payments in writing.
5. Commissions
A commission begins with an agreed written brief covering the subject, size or format, finish, price, payment schedule and expected timescale. Reference material supplied by you must be lawful for us to use and must not infringe another person’s rights.
Reasonable artistic interpretation is part of commissioned work. Any included approval stages and the number of revisions will be stated in the commission agreement. Changes outside the agreed brief may affect price and timescale and require written approval.
Goods made to your specification or clearly personalised normally do not carry the statutory change-of-mind cancellation right. This does not affect rights where work is faulty, not as described or does not match the agreed specification.
6. Delivery and collection
Delivery charges, tracking, insurance, free Redcar collection, international charges and the procedure for delayed or damaged parcels are explained in our Delivery & Returns policy, which forms part of these terms.
Risk passes to a consumer when the piece is delivered to them or to a person they identify to receive it. Ownership passes once we have received full payment.
7. Cancellations, returns and refunds
Your cancellation and return rights depend on whether you bought a ready-made piece or commissioned personalised work. Full instructions, time limits, return costs and the return address are set out in our Delivery & Returns policy.
Nothing in these terms limits rights that cannot legally be excluded, including rights relating to goods that are faulty, not as described or not of satisfactory quality.
8. Care after delivery
You are responsible for appropriate handling and display after delivery. Damage caused by falls, unsuitable cleaning, direct sunlight, heat, moisture, poor storage, improper handling or unauthorised modification is not a manufacturing fault.
9. Intellectual property
Buying a physical piece does not transfer copyright, design rights, trade marks or other intellectual-property rights in Burnt Toast artwork, photographs, branding or website content. You may display and resell the physical item, but you may not commercially reproduce the design, imagery or branding without written permission.
Commission reference images remain subject to their owners’ rights. We may photograph finished work for our portfolio and marketing unless confidentiality is agreed in writing before work begins.
10. Our responsibility
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. We do not exclude liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights.
We are not responsible for business losses where you purchase as a consumer, or for delay or failure caused by events outside our reasonable control, although we will take reasonable steps to minimise the effect and keep you informed.
11. Privacy
We handle personal information as described in our Privacy Policy. Payment providers, couriers and service providers process information only as needed to complete orders, provide services, prevent fraud and meet legal obligations.
12. Changes and governing law
The terms that apply are those displayed when your order is placed, together with any written commission agreement. We may update these terms for future orders.
These terms are governed by the law of England and Wales. Consumers living elsewhere in the UK retain any mandatory protections and may bring proceedings in the courts available to them under applicable law.
13. Contact
